Where a party you are contracting with requires the appointment of a process agent in respect of their English law agreements and they wish to enforce the terms of their agreement with you, we would accept service on your behalf (if appointed). It is not a legal requirement to have a process agent, but if you are contracting under English law, a counter party will often require you to appoint a process agent as part of the contract. This is to ensure that they can enforce the terms of the contract, if necessary.
A process agent is a professional role that needs to give confidence to both the Appointor and the counter party in a contract, in order to fulfil the requirements under the Civil Procedure Rules.
A Process Agent receives service of process as agent for its clients, whereas a Process Server serves proceedings in the UK. Elemental does not act as a Process Server.

Even if you choose to apply via our Word appointment form, the appointment can often be set up the same day, subject to all the necessary information being provided and payment being made.
Six key tips for appointing a provider
Set out below are six of the most important things you can do to make sure that the appointment process goes as smoothly as possible. If you follow these tips then you should have very few issues in finalising your appointment.

Although we can work very quickly and often manage to finalise an appointment within 24 hours, there is no reason to leave the appointment to the last minute. Remember that you will need to provide all the information in our appointment form and also make payment before the appointment can be finalised. The earlier this can be done, the easier everything will be.

Process Agents are generally appointed for the duration of the contract because you don’t know when you are likely to need an agent. It is therefore vital that you understand how long the contract is likely to last for or how long you could potentially be sued for so that they are appointed for the entire time.

To make sure that we can provide the level of service you expect, there is a certain amount of information we need from you including the details of the appointor, the instructing party and the contact for service (as applicable). We will also need details of the contracts we are being appointed in respect of, whether an appointment letter is required and how payment will take place. It is advisable to have all of this information to hand before completing the appointment form to save you time and hassle.
